The vaping retailer NJOY is filing a Citizen Petition requesting that the impending deadlines for the FDA deeming regulations be delayed by another 24-months, and they need your help.  This is not your ordinary, run-of-the-mill petition where you sign your name and it’s soon forgotten.  No, this petition also allows vaping enthusiasts to also post their favorite comments which will become included in the official petition docket at Regulations.gov. 

NJOY holds tremendous political cloud with the Trump Administration.  It was NJOY investor Peter Thiele who helped Donald Trump locate the new FDA Commissioner, Scott Gottlieb – another financial investor of the KURE e-cigarette company who is alleged to be very pro-vaping.

The Consumer Advocates for Smoke Free Alternatives Association (CASAA) is even endorsing this Citizen Petition by posting a full-blown advertisement on their website and spreading the word on social media.  The basis for the petition stems from the new requirement per the FDA deeming regulations for all vape retailers to adhere to the Pre-Market Tobacco Applications (PMTA) process.

Citizens Petition to delay FDA deeming regulations

The PMTA has been around for decades, but it was previously only required for Big Tobacco products.  Now that the FDA has reclassified vaping devices and e-liquids as “tobacco” – even though they are 100% tobacco-free – vape shops around the nation need time to submit their applications and to get them approved.

The trouble is that the FDA has been extremely unclear as to how long the approval process will take, how much it will cost, and if multiple application attempts will be required.  While the FDA website estimates that each PMTA will cost approximately $335,000, an independent research firm recently told the Wall Street Journal that the real price tag could fall in the range of $2-10 million PER PRODUCT.  Whether it’s $335,000 or $3 million, only about 1% of American vape shops can afford these enormous fees.

If the FDA deeming regulations are not repealed and replaced, then thousands of vape shops will be forced to close their doors or face bankruptcy by 2018 when the PMTA requirement officially takes effect.  But it’s already mid-2017, and time is running out.

The American vaping industry needs an extension!

Please educate Pennsylvania politicians. They need to base their laws and regulations on fact not fiction. They can’t compare smoking to vaping.
