Senator ‘Dick’ Durbin demands publication of FDA’s PMTA list for vaping

One of the vaping industry’s most vocal critics, Senator Richard Durbin (D-IL), is now publicly demanding that the U.S. Food and Drug Administration (FDA) publish its white list of PMTA applications. More than a month has passed since the deadline for manufacturers of vapor products to submit a Pre-market Tobacco Applications. 

Per the FDA deeming regulations of 2016, any product without a submitted PMTA – not necessarily an FDA approval – must be immediately pulled from store shelves and online retail websites.   Last month, Mitch Zeller, director of the agency's Center for Tobacco Products, promised to release a complete list of all products who had met the deadline.  Prior to his September announcement, some 400,000 vaping products were already on the market yet only 2000 PMTAs had been submitted.

Senator “Dick,” as this blogger likes to call him, apparently wants to see that FDA white list pronto so that he can send his minions out to the local convenience stores and vape shops to ensure that they are in compliance.  In an October 16 letter addressed to FDA Commissioner Dr. Stephen Hahn, Durbin pushed for an immediate publication.

“In order to protect public health and uphold the duty to enforce against products on the market that are out of compliance, I urge FDA to immediately publish a comprehensive product listing of all relevant e-cigarette applications received by FDA…  While I appreciate the sheer volume of applications submitted to the FDA, and the agency’s intention to prioritize review od those with the greatest market share and public health impact, we know from recent years that youth shift patterns of e-cigarette use based upon what products are available to them. Therefore, it is imperative that FDA publicize its list and incorporate the totality of products that have submitted PMTAs, so thorough enforcement can quickly follow.”

What a dick.  But – to be clear – if Democratic presidential candidate Joe Biden wins the 2020 election, the chances of a federal vaping ban grow increasingly stronger anyway. 

Yesterday, the number of coronavirus cases in the United States hit its highest single-day quantity.  The stock market is plummeting.  Millions of Americans are either out of work, unable to pay their rent, or both.  And Senator Dick somehow thinks flavored vaping is still a national priority.
